| Abstract: | This study examines the impact of the administrative guardianship system on local communities and its contribution to enhancing regional decentralization. While it can constrain local autonomy, it also serves as a mechanism to legitimize actions by adhering to the rule of law, thus promoting democratic governance. Algerian legislation, particularly Municipal Law 11-10 and Provincial Law 12-07, predominantly reflects an administrative nature, balancing between restricting and contributing to regional decentralization. However, there's a need for greater local autonomy to adapt to ongoing transformations. Thus, Algerian lawmakers should focus on activating judicial oversight and enhancing popular control to safeguard local independence, promote local democracy, and protect regional centralization. |
